Federal EPA to enforce New Rules

New Traps Out There for the
Unwary Investor

Federal EPA to enforce New Rules!

Most responsible investors are careful when it comes to Lead Based Paint. Renovation activities on older homes invariably disturb surfaces painted years before with lead-based paints. And, as we know, paints manufactured up through the 1960s often contained lead compounds now known to be toxic to humans and, particularly, young children.

In April 2008 the federal Environmental Protection Agency (EPA) issued a rule governing the use of “lead-safe practices”. The ruling governs rehab. activity of any residential structure built prior to 1978 and, beginning April 23, 2010, carries severe penalties for those who violate the agency guidelines.

Renovation contractors, painters and other trades are specifically covered by the regulations. Beginning April 2010 , property owners (investors) who perform such work must be EPA “certified” as well; such certification may take up to 90 days

The EPA regulations include specific requirements for: notification to tenants, written tenant acknowledgments, and other education and certification conditions. For more information, forms and applications available for download, go to: http://www.epa.gov/lead/pubs/renovation.htm
